> 24/10/2005 MEPSIR study and survey

The European Commission has contracted a Northern Irish company, the HELM group, to assist them with the monitoring and modelling of the change brought about by the PSI Directive.

The contracted study defines, tests and applies a methodology to measure the re-use of Public Sector Information (PSI) in the EU member states and Norway, serving as a basis for the review of the Directive that will take place three years after its implementation. Following the measurement, conclusions will be drawn and recommendations proposed, also on the basis of a comparison with the situation in the United States of America.One of the strands of the monitoring activity is to ask organisations that are commercial re-users of PSI to complete a survey, which takes about 10 minutes.

The Office of Fair Trading is currently working on a Public Sector Information Holders (PSIH) market study, designed to get a clearer picture of the way the market sectors operate. The study will also consider the impact of regulations resulting from EC directives such as the Re-use of Public Sector Information Regulations 2005 which deal with how public sector bodies should respond to requests for the re-use of public sector information.

The draft legislation was approved by the Cabinet last week and has now been sent to Parliament. Subsequently, there are two possibilities:

a. Parliament considers it to be a non-controversial dossier. In that case the entire procedure will be swift and enactment should be expected by the end of this year.

b. Parliament wishes to discuss the matter. In that case there will be plenary debates and enactment could take up to a year.

It is understood that the Dutch legislator proposes to transpose the Directive by implementing it in the Freedom of Information Act.

The Act on the Access to Information of Public Character in Slovenia was amended in May 2005. By this means, the Slovenian Parliament adopted a new law that transposes the EU Directive on PSI reuse into Slovenian law on 15 June 2005.

The OECD has undertaken a series of analytical studies on the digital delivery of content. In the course of the Digital Content Project (www.oecd.org/sti/digitalcontent) specific sectors such as on-line computer and video games, music, scientific publishing and mobile content have been analysed by the OECD’s Working Party on the Information Economy (www.oecd.org/sti/information-economy).

As part of this project, the public sector was recognized as a significant producer of content which is valuable for digital content services for commercial and non-commercial use. Most governments face major challenges managing and distributing this content as it is increasingly digitised and potentially exploitable. The challenges vary across different areas (public sector information such as meteorological data, compared with public sector content such as museum archives). Analysis of the development and distribution of digital public information and content and its commercial use will draw out implications for governments, and prepare more detailed follow-up work in selected areas. Work will focus on analysis of particular areas of public content, beginning with case studies and related economic analysis of the growing role of the exploitation of public content.

The public consultation on the implementation within the UK of the European Directive on the re-use of public sector information closed on 18 March 2005.

The policy responsibility is shared by the Cabinet Office through the Office of Public Sector Information (OPSI), incorporating Her Majesty’s Stationery Office (HMSO), and the Department of Trade and Industry (DTI). The Consultation includes the following documents:

Queries should be sent to the Information Policy team.

The consultation documents have been circulated to other government departments, the Advisory Panel on Public Sector Information (APPSI), the Publishers Association, representatives of the UK information industry, the Digital Content Forum, the Association for Geographic Information, the UK Library community and to the UK Parliament, the Scottish Parliament and the National Assembly for Wales.
